Welcome to Koder, an educational platform operated by Toddlers Town Multipurpose Ventures (“Koder”, “we”, “us”, or “our”).

These Terms & Conditions (“Terms”) govern your access to and use of Koder, including our website, educational content, software, AI-powered features, subscriptions, and related services.

1. About Koder

Koder is a coding education platform designed to help students learn programming through structured lessons, exercises, interactive experiences, and AI-powered educational assistance.

Koder may also provide parents or guardians with information and insights regarding a child's learning activity and progress.

2. Eligibility and Accounts

You must provide accurate information when creating a Koder account.

Koder asks for your age during registration because age may affect how an account is created and whether a parent or guardian must be involved.

Where required, a user below the applicable age threshold may only use Koder through an account connected to or managed by a parent or guardian.

Parents and guardians who create accounts on behalf of children are responsible for providing accurate information and for supervising their child's use of the service as appropriate.

You are responsible for:

• Keeping your login credentials secure;
• Maintaining the confidentiality of your account;
• Providing accurate account information; and
• Not allowing unauthorized persons to access your account.

You should notify Koder promptly if you believe your account has been compromised.

3. Acceptable Use

You agree to use Koder lawfully and responsibly.

You must not:

• Use Koder for unlawful purposes;
• Attempt to gain unauthorized access to Koder or another user's account;
• Interfere with the operation or security of Koder;
• Attempt to reverse engineer, exploit, or circumvent security mechanisms;
• Upload or submit malicious code intended to harm Koder or other users;
• Abuse, harass, threaten, or impersonate another user;
• Attempt to access another student's private learning information without authorization;
• Use Koder to distribute harmful, illegal, or abusive content;
• Attempt to manipulate or exploit Koder's AI systems;
• Use automated systems to abuse or excessively burden Koder without authorization; or
• Otherwise use Koder in a manner that could reasonably harm the service or its users.

We reserve the right to restrict or suspend accounts that violate these Terms.

4. Educational Content

Koder provides educational materials intended to support learning.

While we make reasonable efforts to provide useful and accurate educational content, we do not guarantee that all educational content will always be complete, error-free, or suitable for every learner.

Koder is intended to supplement learning. It does not replace the judgment, supervision, or instruction of a parent, guardian, teacher, or qualified educator.

5. AI-Powered Features

Koder includes AI-powered features that may use third-party AI technologies, including Google's Gemini technology.

The AI assistant may help students:

• Understand programming concepts;
• Work through problems;
• Receive explanations;
• Identify mistakes;
• Ask questions; and
• Continue learning when they are stuck.

Koder may also use AI to analyze learning information and generate insights for parents.

Parents and guardians should use Koder's AI-generated insights as supporting information rather than as a definitive assessment of a child's abilities, intelligence, development, or educational needs.

6. Student Learning Data

Koder may record learning activity such as lesson completion, exercise attempts, answers, code submissions, scores, progress, and interactions with educational features.

This information may be used to provide the Koder learning experience and, where applicable, help parents understand a child's progress.

7. Subscriptions and Payments

Certain Koder features may require a paid subscription.

Prices, subscription periods, available features, and other applicable payment terms will be presented to you before you complete a purchase.

Payments may be processed through third-party payment providers including Stripe, Paystack, and Flutterwave.

Your use of a third-party payment provider may also be subject to that provider's own terms and policies.

Unless otherwise stated at the point of purchase, Koder does not directly store complete payment-card information.

8. Subscription Changes and Cancellation

Koder may offer different subscription plans.

We may change subscription features, pricing, or available plans from time to time.

Where a change materially affects an existing paid subscription, we will provide appropriate notice where required.

Cancellation and refund terms applicable to a particular subscription will be presented at the time of purchase or through the relevant subscription interface.

Nothing in these Terms limits rights that cannot legally be excluded under applicable law.

9. Intellectual Property

Koder and its original content, software, design, branding, logos, graphics, educational materials, and other intellectual property are owned by or licensed to Toddlers Town Multipurpose Ventures unless otherwise stated.

Your use of Koder does not transfer ownership of Koder's intellectual property to you.

You may use Koder's educational content only for your personal or authorized educational use and may not reproduce, redistribute, sell, or commercially exploit Koder's proprietary materials without permission.

10. User-Submitted Content

Users may submit information, questions, answers, code, or other content while using Koder.

You retain ownership of content that you have the legal right to own.

By submitting content to Koder, you grant Koder the limited rights necessary to store, process, display, analyze, and use that content to provide and improve the services.

This may include processing submitted content through third-party service providers where necessary to provide Koder's functionality, including AI-powered educational features.

11. Privacy

Your use of Koder is also governed by our Privacy Policy, which explains how we collect, use, store, and share personal information.

By using Koder, you acknowledge that you have had an opportunity to review our Privacy Policy.

12. Availability of Koder

We aim to keep Koder available and reliable, but we do not guarantee uninterrupted availability.

Koder may occasionally be unavailable because of:

• Maintenance;
• Updates;
• Technical problems;
• Security incidents;
• Third-party service outages;
• Network or infrastructure problems; or
• Circumstances outside our reasonable control.

We may modify, suspend, or discontinue parts of Koder where reasonably necessary.

13. Account Suspension or Termination

We may suspend or terminate an account if:

• The user violates these Terms;
• The account is used fraudulently or unlawfully;
• The account creates a security risk;
• The user attempts to abuse or compromise Koder;
• Payment obligations are not met where applicable; or
• We reasonably believe suspension or termination is necessary to protect Koder or its users.

Users may stop using Koder at any time.

Where appropriate and legally required, we may provide notice before terminating an account.

14. Disclaimer of Warranties

Koder is provided on an “as available” basis.

To the extent permitted by applicable law, we do not guarantee that:

• Koder will always be available;
• The service will always be error-free;
• AI-generated responses will always be accurate;
• Educational content will always be complete or error-free; or
• Koder will produce a particular educational outcome.

15. Limitation of Liability

To the maximum extent permitted by applicable law, Toddlers Town Multipurpose Ventures will not be responsible for indirect, incidental, special, consequential, or unforeseeable losses arising from your use of Koder.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

16. Third-Party Services

Koder may integrate with or rely upon third-party services, including Google, Gemini, Stripe, Paystack, Flutterwave, Resend, Vercel, and other technology providers.

We are not responsible for the independent operation, availability, policies, or practices of third-party services.

Your use of third-party services may be subject to their separate terms and policies.

17. Changes to These Terms

We may update these Terms from time to time as Koder develops or as required by applicable law.

When material changes are made, we may provide notice through Koder or other reasonable means.

Your continued use of Koder after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.

18. Governing Law

These Terms are governed by the applicable laws of the Federal Republic of Nigeria, except where applicable law requires otherwise.

Any dispute relating to Koder will be subject to the applicable courts and dispute-resolution mechanisms under Nigerian law.
